October 9, 2019 @ 11:05 am The October 2019 General Membership meeting of the Dallas Police Retired Officers Association took place at the Dallas Police Association, 1412 Griffin Street East, Dallas, TX 75215.

  • Treasurer Crista Walker

Discussion:

  1. President Elliston called the meeting to order.
  2. Director Erves delivered the invocation.
  3. President Elliston led the membership in the Pledge of Allegiance.
  4. The minutes from the September 2019 meeting had been previously posted on the DPROA website.  A motion was made by member Al Castleman to accept the minutes as posted; seconded by member James Freeman.  Motion carried by acclamation with none opposed.
  5. President Elliston advised that there were representatives present for the City of Dallas healthcare plan, and they would be introduced at the end of the meeting, would give a presentation, and would assist members with sign-up of healthcare coverage for 2020.
  6. President Elliston noted that DPA President Mike Mata agreed to send an email to eligible DPA members to inform them of their ability to join the Annual Adjustment lawsuit when DPROA reopens the lawsuit application process in January for a three-month period.  Those who join in the lawsuit in January, February, or March will be required to pay dues retroactive to June 1, 2019, through December 31, 2019.
  7. President Elliston reported that on September 17, 2019, appellate attorney Kirk Pittard had appeared in Austin before the Texas Supreme Court (TSC) to make arguments in the Degan et al. case pending before the federal Fifth Circuit of Appeals in New Orleans.  No decision has yet been rendered by the TSC.    There is a link on the DPROA website that will allow members to hear the arguments.
  8. President Elliston also reported that attorney George Vie had appeared for a second hearing in Austin pertaining to the Annual Adjustment lawsuit against the Texas Pension Review Board (PRB), and the request to depose Josh McGee, former chairman of the PRB.
  9. Secretary Seguin delivered the Treasurer’s Report on behalf of Treasurer Crista Walker who could not attend.  Checking balance is $269,922.22 and Money Market balance is $276,375.90.  Total in bank is $546,398.12.  There are 1,032 paid participants in the AA/BS lawsuit.
  10. President Elliston stated that there will not be a Ratliff lobbyist report until the November meeting.
  11. Director Erves stated he would be available after the meeting for DPROA  ball cap ($20) and polo shirt ($30) sales.
  12. Based on a question of member Robert Gutkowski, President Elliston stated that he had spoken to new pension board trustee Robert French about the need for an amendment to HB 3158 regarding financial hardship requests.
  13. Vice President Walker advised that while he will not be running for re-election in the DPROA, he intends to run for the position of Commissioner, Precinct 1 in Rockwall County when the election is held in March 2020.
  14. Member Sally Lannom asked about the ability of DPROA to send flowers to the funerals of retired officers.  It was noted that if the board adopted such a policy, it would need to verify if the deceased officer was a DPROA member.
  15. President Elliston noted that when board elections are held in early 2020, Vice President Walker and Treasurer Walker both informed the board that they do not intend to run for reelection.  Members were encouraged to consider whether they might wish to run for those two offices.  The election process will begin soon with Secretary Seguin reviewing the requirements contained in the Constitution.
  16. President Elliston introduced Ms. Amanda Davila who gave a presentation on the 2020 City of Dallas healthcare plan.  When the presentation was completed, President Elliston adjourned the meeting for membership enrollment.
